This document (“TOU”) represents an agreement between you and NARWAL ROBOTICS CORPORATION, a Delaware Corporation, and its affiliated companies (“Narwal”). By using the website at https://my.narwal.com/ (including solely by purchasing a product or service sold via the website) (“Website”), you represent that you are AT LEAST 18 YEARS OLD or the age of legal majority in your jurisdiction of residence, have the capacity and right to agree to, and you do agree to, the terms and conditions herein.

Narwal disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not guarantee that the Website will be uninterrupted, error-free, secure, or free from computer viruses.
6. Limitation of Liability for Website
Your use of the Website is at your own discretion and risk. To the maximum extent permitted by applicable law, Narwal, its affiliates, and its officers shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including lost profits or lost data. In the event of any problem with the Website, your sole remedy is to cease using the Website. If this limitation is found invalid under local law, Narwal’s total cumulative liability shall not exceed the monetary amount actually paid by you to Narwal.

Attributes & Pricing: We make reasonable efforts to display product attributes and colors accurately, but cannot guarantee your monitor's display is precise. Narwal reserves the right to change product availability, attributes, and pricing without notice.

Personal Use Only: You agree that you are purchasing products exclusively for personal use. Commercial resale without authorization is strictly prohibited. You agree to comply with all applicable local and international laws regarding product possession and use.

Territory & Shipping: This storefront operates and accepts orders for fulfillment within its designated delivery zones. Shipping restrictions apply based on logistics availability. All shipments are governed by our local Shipping Policy.

Order Acceptance: Receipts of electronic order confirmations do not constitute formal acceptance of an order. Narwal reserves the right to accept or decline your order for any reason. If an order is canceled after your payment method has been charged, a prompt refund will be issued.

Payment Methods: We accept valid local and international payment options integrated into our checkout, including credit cards and authorized digital payment processors. Title and ownership of products pass to you only upon full receipt of payment; risk of loss passes when the product leaves our fulfillment center.

8. Third-Party Service Providers
Narwal partners with third-party vendors for website hosting, payment gateways, and logistics/delivery fulfillment. Your interactions with third-party tools or payment gateways may be subject to their separate terms of service. Narwal disclaims all liability and warranties regarding third-party services.
9. Miscellaneous Provisions

Assignment: You may not assign your rights or obligations under these TOU to any third party. Narwal reserves the right to assign its rights and duties to its affiliates without restriction.

Severability & Waiver: If any provision of these TOU is deemed invalid or unenforceable by a court of competent jurisdiction, that specific provision will be limited or severed, and the remaining terms will remain in full force and effect. No waiver of any term shall be deemed a further or continuing waiver.
10. Governing Law and Dispute Resolution
Narwal aims to resolve customer disputes efficiently through customer service via support@narwalmy.com.
You agree that this TOU, website usage, and all purchases shall be interpreted and governed by the laws of Delaware, without regard to conflict of law principles, subject to mandatory consumer protection provisions available in your jurisdiction of residence.
Any formal legal disputes, claims, or actions arising out of this agreement that cannot be resolved through customer service channels shall be submitted to binding arbitration through JAMS, with the seat of arbitration designated as Delaware, conducted in English. You agree to resolve all disputes on an individual basis and waive any rights to participate in class-action lawsuits or class-wide arbitrations.
